Terms of Use
END-USER LICENSE AGREEMENT FOR THE ORLANDO INTERNATIONAL AIRPORT MOBILE APPLICATION. PLEASE CAREFULLY READ THE TERMS AND CONDITIONS OF THIS END-USER LICENSE AGREEMENT BEFORE INSTALLING AND USING THIS APPLICATION.
This End-User License Agreement (EULA) is a legal agreement between you and the Greater Orlando Aviation Authority (GOAA) for the MCO Airport Mobile Application. By installing, using or copying the Application, you agree to the terms and conditions of this EULA. If you do not agree to the terms of this EULA, do not install or use this Application. The Application is licensed, not sold, to you for use only under the terms of this EULA. Your Device manufacture is not a party to this EULA and is not responsible for the Application and its content.

LICENSE GRANT. GOAA grants you a personal, limited, non-exclusive and non-transferable right to install and use the Application for your use, that you own or control and as permitted by and subject to the Usage Rules set forth in App Store Terms of Service and Conditions (the Usage Rules). This license does not allow you to use the Application on any Device that you do not own or control, and you may not distribute or make the Application available over a network where it could be used by multiple devices at the same time. Any commercial use by you of the Application is prohibited. You may not rent, lease, lend, sell, redistribute or sublicense the Application. You may not copy decompile, reverse engineer, disassemble, attempt to derive the source code, modify, or translate, modify or create derivative works of the Application, any updates, or any part thereof (except as and only to the extent any foregoing restriction is prohibited by applicable law or to the extent as may be permitted by the licensing terms governing use of any open sourced components included with the Application). Any attempt to do so is a violation of the rights of GOAA. If you breach this restriction, you may be subject to prosecution and damages.

UPDATES AND AMENDMENTS. The terms of this EULA will govern any upgrades provided by GOAA that replace and/or supplement the original Application, unless the upgrade is accompanied by a separate end-user license agreement, in which case the terms of that agreement will govern. GOAA reserves the right, at its discretion, to change, modify, add or remove portions of this EULA at any time by updating an amended EULA in the Application. You may be given additional notice, such as an e-mail message or messaging within the Application, of any changes. You will be deemed to have accepted the changes by continuing to use the Application. Except as otherwise stated, all amended terms will be effective when accepted by you or 30 days after they are initially posted, whichever first occurs. This EULA may not be otherwise amended. If at any point you do not agree to any portion of the then-current version of this EULA, your license to use the Application will immediately terminate and you must immediately stop using the Application.

CONTENT; PROHIBITIONS. You are solely responsible for your conduct and any data, text, information, screen names, graphics, photos, images, musical works, works of authorship, profiles, audio and video clips, links, applications or any other materials (Content) that you submit, post and display in connection with the Application. You agree that you will not, directly or indirectly, do any of the following acts:
- create an account or access the Application if you are under the age of 16;
- allow access to children under the age of 16 to the Application. You accept full responsibility for any unauthorized use of the Application by minors in connection with your account. You are responsible for any use of your credit card or other payment instrument (such as PayPal) by minors;
- have more than one account, per platform or SNS, at any given time, or create an account using a false identity or information, or on behalf of someone other than yourself;
- have an account or use the Application if you have previously been removed by GOAA;
- remove or alter any legal notices or other markings or legends, such as trademark and copyright notices, affixed on or within the Application; and
- remove, alter, modify, disable or reduce any anti-piracy measures or components contained in the Application.
- SHARING OF YOUR INFORMATION. GOAA may share your information (in some cases personal information) with third parties in the following circumstances:
- Third Party Service Providers. GOAA may provide your information to third party companies to perform services on GOAA’s behalf, including data analysis, surveys, e-mail delivery, hosting services, software development, customer service and to assist GOAA in its marketing efforts. GOAA directs all such third party service providers to maintain the confidentiality of the information disclosed to them and to not use your information for any purpose other than to provide services on GOAA’s behalf.
Advertising of Third Party Products and Services:
- GOAA does not actively share personal information with third party advertisers for their direct marketing purposes. GOAA may share (i) aggregated information (information about you and other users collectively, but not specifically identifiable to you); (ii) anonymous information; and (iii) certain technical information to develop and deliver targeted advertising on the websites of third parties.
- GOAA may also allow advertisers to collect such types of information (e.g., by allowing advertisers to run surveys that give users the option to anonymously report age range and gender) and such advertisers may share such information with GOAA. Advertisers may collect information through the use of tracking technologies like browser cookies and web beacons. The information collected may be used to offer you targeted ad-selection and delivery in order to personalize your user experience by ensuring that advertisements for products and services you see will appeal to you, a practice known as behavioral advertising, and to undertake web analytics (i.e., to analyze traffic and other end user activity to improve your experience).
- Consent to Use of Data. You agree that GOAA may collect and use technical data and related information, including but not limited to technical information about your device, system and application software, and peripherals, that is gathered periodically to facilitate the provision of software updates, product support and other services to you (if any) related to the Application. GOAA may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide services or technologies to you.

TERMINATION. The license granted hereunder is effective until terminated by you or GOAA. Your rights under this EULA will terminate automatically without notice from GOAA if you fail to comply with any term(s) of this EULA. Upon termination of the license, you agree to cease all use of the Application, and destroy all copies, full or partial, of the Application. GOAA has the right to terminate this agreement at any time without notice.

SERVICES; THIRD PARTY MATERIALS. The Application may enable access to GOAA's and third party services and web sites (collectively and individually Services). Use of the Services may require Internet access and that you accept additional terms of service. You understand that by using any of the Services, you may encounter content that may be deemed offensive, indecent, or objectionable, which content may or may not be identified as having explicit language, and that the results of any search or entering of a particular URL may automatically and unintentionally generate links or references to objectionable material. Nevertheless, you agree to use the Services at your sole risk and that GOAA will not have any liability to you for content that may be found to be offensive, indecent, or objectionable. Certain Services may display, include or make available content, data, information, applications or materials from third parties (Third Party Materials) or provide links to certain third party web sites. By using the Services, you acknowledge and agree that GOAA is not responsible for examining or evaluating the content, accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect of such Third Party Materials or web sites. GOAA does not warrant or endorse and does not assume and will not have any liability or responsibility to you or any other person for any third party Services, Third Party Materials or web sites, or for any other materials, products, or services of third parties. Third Party Materials and links to other web sites are provided solely as a convenience to you. You agree that any Services contain proprietary content, information and material that is protected by applicable intellectual property and other laws, including but not limited to copyright, and that you will not use such proprietary content, information or materials in any way whatsoever except for permitted use of the Services. No portion of the Services may be reproduced in any form or by any means. You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the Services, in any manner, and you will not exploit the Services in any unauthorized way whatsoever, including but not limited to, by trespass or burdening network capacity. You further agree not to use the Services in any manner to harass, abuse, stalk, threaten, defame or otherwise infringe or violate the rights of any other party, and that GOAA is not in any way responsible for any such use by you, nor for any harassing, threatening, defamatory, offensive or illegal messages or transmissions that you may receive as a result of using any of the Services. In addition, Services that may be accessed from, displayed on or linked to or from Apple or Google Devices are not available in all languages or in all countries. GOAA makes no representation that such Services are appropriate or available for use in any particular location. To the extent you choose to utilize such Services, you do so at your own initiative and are responsible for compliance with any applicable laws, including but not limited to applicable local laws. GOAA reserves the right to change, suspend, remove, or disable access to any Services at any time without notice. In no event will GOAA be liable for the removal of or disabling of access to any such Services. GOAA may also impose limits on the use of or access to any Services, in any case and without notice or liability.

INTELLECTUAL PROPERTY RIGHTS.
- Reservation of Rights. You have obtained a license to the Application and your rights are subject to this EULA. Except as expressly licensed to you in this EULA, GOAA reserves all right, title and interest in the Application (including all images, photographs, animations, video, music and text), and all associated copyrights, trademarks, and other intellectual property rights. This EULA is limited to the intellectual property rights of GOAA in the Application and does not include any rights to other patents or intellectual property. You may not remove, alter, or obscure any product identification, copyright, or other intellectual property notices in the Application. All rights not expressly granted herein are reserved by GOAA.
- Your Contributions. GOAA does not claim any ownership rights in the Content that you submit, post or display on or through the Application, including without limitation Content that you submit for use in surveys. In exchange for use of the Application, and to the extent that your Content through use of the Application gives rise to any copyright interest, you hereby grant GOAA an exclusive, perpetual, irrevocable, fully transferable and sub-licensable worldwide right and license to use your Content in any way and for any purpose in connection with the Application and related goods and services, including the rights to reproduce, copy, adapt, modify, perform, display, publish, broadcast, transmit, or otherwise communicate to.
